USCIS has announced changes to the H-1B cap filing process for Fiscal Year 2021. The changes to the H-1B cap include a mandatory electronic pre-registration process. Employers seeking to file an H-1B cap-subject petition for FY 2021 must first electronically register and pay a nominal registration fee. Registration will require basic information about company and each H-1B cap-subject applicant. The registration period will open on March 1, 2020 and continue through March 20, 2020. Companies will subsequently be notified which of their registrations have been selected to submit a full H-1B petition. Starting on April 1, 2020, USCIS will begin accepting new H-1B petitions subject to the fiscal year 2021 quota, with an H-1B start date of October 1, 2020.
If you wish to discuss the changes, we strongly encourage you or your employer to contact our office and schedule a consultation with one of our attorneys as soon as possible.
